Malbachi is a United States Citizenship and Immigration Services (USCIS) approved petitioner for talent-based Visa applicants. Foreign clients who contract with us as business managers, agents, or consultants and are applying for relevant visas (Os or Ps), are eligible for this service as a courtesy.

We have successfully sponsored a variety of artists worldwide, including award-winning actors, writers, musicians, and directors. For our international artists with extraordinary abilities or culturally unique work, we liaise only with experienced and vetted immigration attorneys to help facilitate your successful non-immigrant application.

An agent petitioner allows the beneficiary to work for more than one employer, provided that each employer signs a contract with the petitioner or authorizes the petitioner to act on their behalf for the sole purpose of filing a given visa petition and nothing else. The adjudicating entity, United States Citizenship Immigration Services (USCIS), also requires a contract between the beneficiary and the employer
regarding the terms of the employment, including specific details about compensation, the nature of the work to be done, and the location where the work will take place.

An agent petitioner does not necessarily need to be an agent by definition. It can be someone in the beneficiary’s field willing to sponsor the beneficiary for up to 3 years. A U.S. Agent may be the actual employer of the beneficiary, the representative of both the employer and the beneficiary, or a person or entity authorized by the employer to act for, or in place of, the employer as its agent.

The rules for agents filing petitions are also outlined in 8 C.F.R. 214.2(o)(2)(iv)(E). Additionally, the rules are fleshed out in a 2009 USCIS Memorandum titled “Requirements for Agents and Sponsors Filing as Petitioners for the O and P Visa Classifications” (“Agent Memo”) [PDF version].
